It is obvious that if your Bonds are Lost, then you should contact the Police.

As mentioned previously The Australian Office of Financial Management Sell Bonds. The ASX also Sell Bonds as does Computershare Investor Services.

It is possible for Employee’s of these Three Companies to accidently create a Legal Loophole. More on this later…

In a case where the Bonds have been Stolen the punishment can be severe. To my knowledge in order for the Bonds to be accepted in a Bank, due care must be taken to ensure the Bonds have not been Stolen. A Legally Binding International Declaration will have been signed stating the Bonds have not been Stolen and Imprisonment is likely for offenders.

This Declaration is Verified when making a Deposit of the Bond to an unknowing Bank.

Gifting

As previously mentioned, Order Instruments are often purchased as a Generous Gift from One Person to Another Person. It is known, there is no limit on how much money you can receive as a gift however the money must be earned lawfully and tax rules may apply.

I understand Tax File Numbers are required when purchasing the Bonds.

Holdings

I understand currently Bond Information Holdings are with Computershare Investor Services Pty Ltd. This is where the Purchase Order information may be Retrieved unless the Bonds were purchased elsewhere. A Receipt for this Gift must be stored for a Hundred Years. As mentioned previously, this Receipt is also known as a Purchase Order.

In the 1990’s I believe the Holdings for Bonds were with the Reserve Bank of Australia. The Bond information will include the Purchaser’s details along with the Recipients details to the Valuable Gift, if the Bond is an Order Instrument.

For Financial Institutions to be able to accept and make payments to the Bank Accounts of the Owners of the Order Instruments, Bank Forms need to be Signed. A Person’s Signature is required as the Order Instruments have the details of the Recipient to the Valuable Gift assigned to them.

As mentioned above the person depositing the Bond must Verify with the Bank the Bonds are Not Stolen…

It is Obvious if the Bonds are Stolen and Forgery of a Signature is required to make the Deposit to a Bank. In this instance the Law has been Broken, with the Criminals being Dealt with Stringently.

A Deceased Estate

What happens when the Owner of the Order Instruments Passes Away?

In the event of the Recipient to the Gift or Owner being Deceased, the Order Instrument can be made Bearable or Payable to anyone, if the Bond is Not Claimed in the Deceased Estate. This is known as Unclaimed Prize Money.

Another popular way to obtain unowned or abandoned property is to abide by the Unwritten Rule of ‘Finders Keepers Losers Weepers‘, of which many criminals and children alike, abide. Perhaps there is also a Legal Avenue using this premise. Does anyone have an example where Finder Keepers Loosers Weepers prevailed in a Courtroom setting?

Treasury Direct – USA

The United States has a Government Department called The Treasury Direct Pty Ltd, that deals with Bonds.

Treasury Direct provide a Lost, Stolen and Destroyed Form that can be submit to Retrieve the Missing Bonds, even if Bond Serial Numbers are not available.

A Tax File Number is associated with the Bonds making an investigation easy. As mentioned previously I assume Tax File Numbers are required in Australia, when purchasing the Bonds and Gifting them to a Third Party.

I have not been able to Find a Similar Form in Australia for Lost, Stolen or Destroyed Bonds, that the USA offer its customers…
